A Karnataka high court order and a police licensing regime have made Freedom Park Bengaluru’s default protest venue. But the governing police order also gives the police commissioner discretion to designate another suitable venue, meaning the legal position is more nuanced than an absolute ban on demonstrations elsewhere. Here’s everything you need to know about why Bengaluru cannot protest outside Freedom Park:Bengaluru has confined protests to Freedom Park. The practice emerged from a suo motu Karnataka High Court case initiated in 2021 over the effect of demonstrations on traffic and the rights of people not participating in them. How did the restriction begin? On March 3, 2022, a division bench of the Karnataka High Court passed an interim order directing the state government to ensure that no protests, processions and similar activities were held anywhere in Bengaluru except at Freedom Park, Gandhinagar. The court also directed that such activities be organised without adversely affecting traffic, especially during rush hours, and that action be taken where traffic was disrupted. On August 1, 2022, the High Court disposed of the case. In paragraph 4, it recorded a submission that protests, marches and dharnas would be permitted only at Freedom Park, and that the state was obliged to ensure compliance with the 2021 licensing order. In paragraph 5, the operative direction required authorities to ensure compliance with that order “in letter and spirit” and to continue action against those violating it.What does the police order say?The Licensing and Regulation of Protests, Demonstrations and Protest Marches (Bengaluru City) Order, 2021, published in the state gazette in January 2022, is the rule currently governing protests in Bengaluru. It says no protests, demonstrations, dharnas or protest marches may be held in the city without a licence under the order.Clause 4.1 identifies Freedom Park as the venue for protests in Bengaluru. However, it also says that, depending on the situation, the commissioner of police may designate any other suitable place in the city for that purpose. The licensing authority may approve the number of participants at Freedom Park based on the type of programme, duration and available capacity. So, are protests outside Freedom Park illegal? Not necessarily in every circumstance. The 2021 order does not expressly prohibit protest marches, nor does it state that Freedom Park is the only possible venue: it identifies Freedom Park while preserving the police commissioner’s discretion to designate another suitable location.A legal backgrounder prepared by activists argues that the High Court’s final order did not itself direct that protests be held only at Freedom Park; it directed compliance with the licensing order. On that reading, the court’s judgment does not prevent rallies and does not mandate Freedom Park as the sole venue. The distinction matters because the March 2022 interim order did expressly restrict protests and processions to Freedom Park, while the August 2022 final order required enforcement of the 2021 licensing rules. The two must be read alongside the licensing order before drawing a definitive legal conclusion.

Why does this matter?Activists argue that concentrating demonstrations at one venue reduces their visibility and makes it harder for groups to draw public attention to local grievances. The backgrounder says the restrictions have affected workers, farmers, Dalit activists, sanitation workers and residents seeking to protest on issues in their own localities. The debate is ultimately about balancing traffic management and public convenience with the constitutional right to assemble peacefully and express dissent. For now, Freedom Park remains Bengaluru’s designated and practically dominant protest venue. Whether the police commissioner’s discretion to permit demonstrations elsewhere is exercised, and on what terms, remains central to the controversy.
