Central Administrative Tribunal stays promotion of two IPS officers ahead of seniors in Karnataka

Bengaluru: The Central Administrative Tribunal (CAT) Thursday issued an interim stay on the state govt’s recent order promoting two IPS officers to the rank of director general of police (DGP) ahead of their seniors.The stay followed a petition by additional director general of police (ADGP) Alok Kumar, who had moved CAT against disciplinary proceedings initiated against him on May 9 and against the promotion of his junior batch officers. CAT had, on May 14, issued an interim stay against proceeding against him.On Sept 4, CAT delivered a split order in the case. While the judicial member ordered quashing of the disciplinary enquiry (DE) against Alok, the technical member recommended initiating disciplinary proceedings. The matter had been referred to a third judge for a final ruling. Meanwhile, Alok filed a miscellaneous application to restrain the govt from promoting his juniors. On Sept 11, CAT clarified that its earlier interim stay would continue and directed the govt to abide by it.However, according to sources, the govt interpreted the split order as a final decision and proceeded with promotions. On Sept 12, Umesh Kumar was posted as DGP (recruitment), while Arun Chakravarthy J was promoted as DGP and continued in his role as CMD of Karnataka State Police Housing and Infrastructure Development Corporation.The CAT has now issued notices to the state govt and secretary, along with emergent notices to Umesh Kumar and Arun Chakravarthy. The next hearing in the matter is scheduled for Oct 23.
